FOR THE FOUNDATION OF THE INTERNATIONAL ASSOCIATION OF MILITARY
JUSTICE |
On
the 2nd of December of 2003, at the city of Florianópolis, in the State of
Santa Catarina, in Brazil, in a meeting under the direction of Judge Getulio
Correa, Auditing-Judge of Santa Catarina State, began the discussion towards
the foundation of the
International Association of Military Justice, with the following participants:

BELDA,couselor judge of the Central Military Tribunal of Spain, FRANCISCO

SÉRGIO CEA CIENFUEGOS,colonel and lawyer of the Military Justice of Chile;
ERNEST ZWANE BRIG, general of the National Defense Force of South Africa;CHARLES
ERDMANN,judge of the Court of Appeals of the Armed Forces of the United States
of America; PIERRE BRICARD, judge
of the Defense Ministry of France; BEATO MANOEL PAULO, magistrate colonel of
the Public Ministry of Angola; JOÃO CARLOS BONA GARCIA, magistrate and
president of the Military Tribunal of the State of Rio Grande do Sul; AVIVALDI

Paraná; SIDNEY ELOY DALLABRIDA,military justice prosecutor of Santa Catarina
State; ROBERTO RITTER VON JELITA,federal lawyer; MARCOS BAYER, lawyer,
consultant and professor; UNIVALDO CORRÊA, auditing judge of the Military
Justice of the State of Santa Catarina.
I,
Univaldo Corrêa, as a secretary of this meeting, and with simultaneous
translation for Portuguese, Spanish and English, in charge of the whole
transcription of the discussion,
declare that everyone made their own presentation at the event.
The
director of the meeting, Judge Getulio Correa, made a brief retrospection about
the idea of the foundation of this Association, since the previous meeting that
took place in Brasília, in the 2000, at the time of the I International
Meeting of Humanitarian Law and Military Law,
where representatives of eleven countries manifested their interest in
the constitution of an international association for those interested in the
studies of Military Law and Military Justice.
After
these comments, there was an
analisis of the statute of the Association, that was offered in the three
languages mentioned above. It was asked for suggestions with a relevant meaning,
considering the intention to have
another meeting in the year 2004, with the specific purpose to discuss the
statute in an accurate form. However, according to the general opinion, item 5
of the second paragraph that concerns the unification of legislation in
different countries was removed.
It
was agreed that the directing board of the association, called Administration
Council, would be composed of a President, 2 Vice-Presidents, 5 Counselors, a
Secretary and a Financial Director. It was agreed the the nomination for those
positions above would be done among the participants of the meeting. It was
also proposed the add an item on article 16 in order to define a way for a
voluntary dismissal from the
association. It was also decided to fix an annual fee of US$ 20,00 (twenty
american dollars) for individuals and a fee of US$ 100,00 (one hundred american
dollars) for instituitions that want to be members of the association. It was
decided that in the next year, 2004, during the months of July or August
another meeting would be held to
discuss the statute, in another country and
that in the year 2005, in a different country, would happen the III
International Meeting of
Humanitarian Law and Military Law.
Right
after this began the nommination for the Administrative and Deliberative
Counsils, composed such as bellow:
Another
decision that was takenis that this new association,
while does not have proper funds, can use the funds of AMAJME for
communication purposes.
Those
who have participated in this meeting and also those who have been in the
meeting of Brasilia, mentioned before, are considered founder members of this
association.
Finally
the director of the meeting declared the end of the discussions and announced
the creation of the INTERNATIONAL ASSOCIATION OF MILITARY JUSTICE, and I wrote
this ACT that will be signed by me and the other participants.
